Complying development is development which complies with predetermined criteria and can be certified by Techton. These types of development can include: single storey houses, alterations and additions, garages, sheds, patios etc.
Generally each Council has their own Development Control Plan (DCP) that stipulates what developments are complying developments. This DCP will state what the prescribed conditions for each type of complying development are.
In addition there are also Exempt Developments. These are developments where no formal approval is required. Again each Council will have their own DCP which will prescribe the conditions that must be met for a development to be exempt.

The State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (the Codes SEPP)
The State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (the Codes SEPP) has been amended to significantly expand the range of exempt and complying development across the State and increase the number of properties to which the Codes SEPP applies
The Codes SEPP is an important policy initiative put in place by the NSW Government to remove red tape for low risk and low impact development, and directly results in significant time and cost savings for home owners and small business.

You can determine whether your building or renovation requires a complying development certificate or is exempt development through the Electronic Housing Code website. If your building or renovation requires a complying development certificate you can apply for it online using the Electronic Housing Code which also allows you to:
Investigate your development options for an individual site, including the identification of land based restrictions
Generate an exempt and / or complying development report
Prepare your complying development application electronically
Select your preferred Certifier from a pre-nominated list
Lodge your application electronically
Monitor the progress of your application
View and download your complying development determination

Certificates of Insurance - Dont be fooled read the requirements
Legislative Requirements
The Home Building Act 1989 contains provisions requiring home warranty insurance to be obtained for certain residential building work undertaken by builders and owner-builders.
The Act also requires that builders, owner-builders and developers provide homeowners with a Certificate of Insurance as evidence that a Contract of Home Warranty Insurance (i.e. policy) is in place for the work.
Under the legislation governing the operation of the development and construction approval process (Environmental Planning and Assessment Act 1979), the Council/Principal Certifying Authority (PCA) is required to be notified of the builder for the project. It is also a standard condition of the approval for a residential building project that home warranty insurance be obtained. Where home warranty insurance is not obtained, the Council/Principal Certifying Authority may not be able to issue an occupation certificate for the completed building work. This may impact on the ability to legally occupy the completed building work and may also adversely impact on the future saleability of the property and its market price.
